Multiple Listing Service (MLS)

The trademarks known as MLS, Multiple Listing Service and the MLS design marks are certification marks registered and owned by The Canadian Real Estate a__ociation (CREA). These marks are protected throughout Canada for the exclusive use of members of CREA in connection with services defined as listing to effect the purchase and sale of real estate. The certification marks may only be used in a__ociation with listing services performed as part of a plural system arrangement and are performed by members in good standing of The Canadian Real Estate a__ociation.

MLS Service

Real estate boards enrolled with CREA are authorized to use certain certification marks relating to the operation of a real estate data base service, namely, MLS,Multiple Listing Service, and MLS logos.

Individual real estate boards must maintain by-laws and rules/regulations pertaining to the operation of the MLS service that give effect to a number of CREA requirements. Specifically, CREA sets out requirements for the operation of the real estate data base service, e.g., access to the listing service is normally limited to licensed real estate brokers and salespersons who are members; all listing contracts must be signed by the registered owner and submitted to the board; limited access to non-members (other than listing access); the general scope of listing information to be circulated; and notification of sales and other related information. Individual real estate boards may permit access to non-licensed affiliate members by way of specific contracts.

MLS Listing

An MLS listing is an exclusive listing with an added marketing feature. Multiple Listing Services are operated by real estate boards. A signed multiple listing form contains an authority from the seller permitting the listing brokerage to employ the services of co-operating brokerages who are members of the real estate board. The responsibility regarding promotion, negotiations, and payment of commission to co-operating brokerages rests with the listing brokerage. An MLS listing is always in writing.
