REALTOR

The term REALTOR refers to real estate professionals in Canada who are members of The Canadian Real Estate a__ociation (CREA) and to members of the National a__ociation of REALTORS (NAR) in the United States. Members subscribe to a high standard of professional service and to a strict code of ethics. Members in Canada are licensed by CREA to use the REALTOR marks in connection with or in reference to themselves and their real estate businesses.

CREA is responsible for maintaining authorized and proper use of the trademarks REALTOR, REALTORS, and the REALTOR logo in Canada. CREA has an agreement referred to as the Trademark License and International Affiliate Agreement with NAR (being renegotiated at time of printing) concerning the REALTOR trademarks.
Application

Only individuals who are members of CREA by virtue of holding membership in a member board or a__ociation, are licensed to use one or more of the REALTOR marks in connection with or in reference to themselves as individuals and for their real estate business, but not as part of their corporate name or business name. The marks may be used by brokers or salespeople as marks that identify membership in CREA and not as synonyms for broker or salesperson or any other real estate professional calling.

The criteria for membership in a local board are determined by that board. A member board may not confer membership that entails use of the REALTOR marks on individuals engaged in activities not currently recognized in the definition of real estate business as set out in the CREA publication t__led Real Estate Trademarks Manual.

An individual's licence to use the REALTOR marks terminates automatically in the event such individual ceases to be a member in good standing of a member board, for failure to pay dues, or any other reason, or in the event such individual ceases for any reason to be a member in good standing of The Canadian Real Estate a__ociation. A non-member is never authorized to use the REALTOR term or logo in connection with his/her name or business.

What the term REALTOR does not identify is the occupation of its user. In fact, REALTORS may be engaged in many occupations that form part of the real estate business, e.g., real estate brokerage, property management, mortgage financing, appraising, real estate counselling, real estate syndication, and development, and building.

Trademarks are nothing more than unique terms, symbols, or combinations of terms and/or symbols that communicate some specific message to the public. Over time, marks become a__ociated with standards of quality or care and the public looks upon such marks as guarantees of repeated quality of care.

Trademarks not properly protected are soon lost. Preservation of trademarks requires that they be used only in their trademark sense, that they be distinguished from words of ordinary use by the use of capital letters, and that the rules governing use of the marks be adhered to in accordance with certain standards of services or qualifications of their user.
